his was an appeal won in our favor in the case later tried before the jury mentioned directly above. The issue on appeal was whether the plaintiff Fine needed to produce to us before trial her list of brokerage customers. The plaintiff argued that the list was a “trade secret”. We argued the list constituted evidence necessary to impeach the credibility of Ms. Fine before the jury. The Court rejected the plaintiff’s argument of “trade secret” ordering production of the list which was used with success at the jury trial.
